Writ petitions under article 226 of the Constitutions of India
praying that in these circumstances stated therein and in the
respective affidavits filed their with the High Court will pleased to
issue a writ of certiorarified mandamus or any other order, direction
in the nature of appropriate writ to call for the records of the
Impugned order dated 24.10.2019 passed in M.A.NO 11/2019 on the file
of the 3rd Respondent and quash the portion of the order that if due
amoutn recovered from Andhra Property and Mumbai Property is found
not sufficient then Bank has a right to recover the balance money
from Adyar Property also and allow the Appeal filed by the Petitoner
to quash the impugned order dated 29.5.2018 passed in A.P.NO 07/2018

Order : This petition coming on this day for hearing upon
perusing the petition and the affidavit filed in support thereof and
upon hearing the arguments of MR.E.OMPRAKASH, SENIOR COUNSEL ASSISTED
BY MR. P.ELAYARAJ KUMAR, FOR MR.RAMALINGAM AND ASSOCIATES Advocate
for the petitioner and of MR.SATHISH PARASARAN, SENIOR COUNSEL FOR
M/S.PRAHLAT BHAT for respondents the court made the following order:-
The matter will appear a week after the summer vacation.
In the meantime, no further third party rights ought to be
created in respect of the residential house at Old No.60, New No.30,
III Main Road, Gandhi Nagar, Adyar, Chennai 600 020 or in respect of
the agricultural land at Manapakkam Village near Chennai (extent Ac
7.69 patta land and Ac 1.22 poramboke land) together with out-house,
cow-sheds, etc. and the wells and pump-sets thereat.
The adjournment is granted in the hope that a negotiated
settlement may be arrived at to bring a final closure to the matter
that has been lingering for a considerable period of time.
