TCC Information Private Limited (referred to as " The Company Check " or "TCC") is a company registered under the Companies Act, 2013, with its registered office located at Gurgaon Haryana, 122018, India.

The Company Check is an independent analytics platform that provides comprehensive data and analytical services on all Indian corporates through the proprietary portal https://www.thecompanycheck.com, ("Website").

These Terms of Service ("Terms") constitute a binding contract between TCC Information Private Limited (“Our” “Us” and “We”) and the person reading them ("User", which expression means, in the event the individual reading the Terms is representing any other person, including any juristic person, such person) as an account holder on the Website.

These Terms govern your access to and use of the Platform, which includes our website (https://www.thecompanycheck.com/), user portal, browser extensions, mobile applications, generated reports, export downloads, browsing information, cookies, third-party cookie platform, third-party links, API usage, and query responses from our team via email, phone, or other communication channels, as well as billing and payment information and any additional platform (collectively referred to as the "Platform"). By registering, using, or accessing the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. End User Only

Additionally, users must not use the offering in any way that allows a third party to substitute it for our offering, nor should they copy the data to any databases accessible by non-end users.

User Obligations

Violating these clauses may be a criminal offense under applicable laws. The Company Check will report such violations and may disclose your identity to law enforcement authorities.

Commercial Terms

By subscribing to our paid platform, you agree to pay all applicable fees as communicated to you. Please note that the fees are exclusive of any applicable taxes, which will be your responsibility to cover. We will notify you in advance of any changes to the fee structure. Additionally, you acknowledge that the payment facility provided by The Company Check is intended solely for facilitating electronic payments and is not a banking service.

You will ensure that

All billing and contact information provided is true and correct;
Ensure that all payments comply with applicable law; and
Make payments only from accounts directly held in your name, avoiding third-party accounts.

Failure to pay the Fees may result in suspension or termination of these Terms and limit your ability to use the Platform.

Termination and Suspension

The Company Check reserves the right to terminate the Platform at any time, with or without notice, and for any reason, without incurring any liability to you. If you violate these Terms or any related guidelines, The Company Check may terminate these Terms immediately and without notice.

Termination of these Terms does not absolve you of any liabilities incurred before the termination. Upon termination, we may delete any content or materials associated with your use of the Platform, and we will not be liable to you or any third party for such actions.

Refunds & Cancellation

The subscription fee is non-refundable. We do not issue refunds for digital products once the order is confirmed. However, in the case of non-delivery of the ordered item, we may issue a refund for the payments made for the non-delivered items.

Any refunds to be made will be made through the same medium as originally received. Refunds are usually processed within 7 to 10 working days post verification and necessary documentation.

Confidentiality & Privacy

The parties acknowledge that they may receive confidential and privileged information from each other that should not be shared with third parties or others, except as necessary to fulfill these Terms. The parties agree to use reasonable measures to protect this information. However, this does not impact their ability to disclose information as required by applicable laws.

The Company Check collects minimal personal information solely to facilitate access and monitor compliance with the terms of service of the Platform. The Company Check agrees not to disclose, sell, or profit from any user's personal information.

Governing Law and Arbitration

These Terms are governed by and interpreted according to the laws of India, and any disputes, claims, or actions, whether contractual or non-contractual, related to these Terms will fall under the exclusive jurisdiction of the courts in Gurgaon.

Miscellaneous

Waiver - If we choose not to exercise any right under these Terms, or if there is a delay in doing so, it should not be interpreted as a waiver or acceptance of that right.

Severability - If any part of these Terms is deemed invalid or unenforceable to any extent, the rest of the Terms will remain unaffected and continue to be in full force and effect as allowed by law.

Availability - We are not liable for the Platform being unavailable during scheduled maintenance or any unexpected suspension of access due to reasons beyond our control.

Assignment - Your right to use the Platform is personal and cannot be transferred to others.

Force Majeure - Neither party will be held responsible for failing to meet their obligations under these Terms due to events beyond their control, such as war, government regulations, accidents, floods, or similar circumstances.
